General Terms & Conditions – Thin Wall Packaging Academy

 

1. Scope

These General Terms and Conditions (GTC) apply to all courses, training sessions, and events organized by Thin Wall Packaging Academy, as well as to the provision and use of all freely accessible digital applications and web apps (hereinafter referred to as “free apps”).

 

2. Registration & Contract Formation

  1. Courses & Seminars: Registration for courses is made informally via email or through our website and becomes binding upon our written confirmation.
  2. Free Apps: Access to the apps is provided directly via a link without requiring registration. No formal usage contract is created. There is no legal entitlement to access, availability, or specific functionality of the apps.

3. Terms of Payment

  1. Course fees are due within 10 days of registration. For short-notice registrations (less than 14 days before the course start), payment is due immediately upon receipt of the invoice.
  2. The use of the provided test apps is free of charge.

4. Provision & Use of Free Apps

  1. The apps are provided on an “as is” basis and solely for testing and informational purposes.
  2. We reserve the right to modify, restrict, change, or completely discontinue the free apps at any time without prior notice.
  3. Users are solely responsible for providing the necessary technical requirements (e.g., compatible browser, internet connection) to use the apps.

5. Cancellation by Participants (Courses)

  • Up to 6 weeks before course start: Free cancellation.

     

  • Up to 4 weeks before course start: 50% of the course fee.

     

  • From 2 weeks before course start or in case of no-show: 100% of the course fee.

     

  • You may nominate a substitute participant at any time with prior notice.

     

6. Cancellation or Changes by the Organizer

If a course must be cancelled or postponed due to illness of instructors, insufficient registrations, or force majeure, we reserve the right to reschedule or cancel. In such cases, any fees already paid will be fully refunded. Further claims are excluded.

 

 

7. Copyright & Usage Rights

  1. All course content, as well as the software, calculation methods, designs, texts, and user interfaces of the apps, are protected by copyright.
  2. Users are granted a simple, non-exclusive, and non-transferable right to use the apps for their own informational and testing purposes.
  3. The following is strictly prohibited:

     

    • Sharing, reproducing, or embedding the apps or their content into third-party systems or websites without express written consent.
    • Decompiling, reverse engineering, or extracting source code from the apps.
    • Using the app results or the apps themselves for commercial training or services provided to third parties without written permission.

8. Limitation of Liability for App Usage

  1. The content and functions of the apps have been created with great care. However, we assume no liability or warranty for the accuracy, completeness, timeliness, or correctness of the output, results, or calculations.
  2. Any liability for damages resulting directly or indirectly from the use of the free apps or reliance on their results is excluded to the extent permitted by law.
  3. For course participation, our liability is limited to cases of intent and gross negligence.

9. Data Protection

The use of the free apps occurs without collecting personal user account data. Insofar as technical data (e.g., IP address) is processed during server calls, this is done in accordance with our separate Privacy Policy.

 

10. Applicable Law & Jurisdiction

Swiss law applies. The place of jurisdiction is Zurich.
